Terms and conditions

1. Contract (Agreement)

Sale and distribution of the goods on offer is done to association members only and does not serve commercial purposes.
With the order a sales contract is concluded between the Buyer and the EMPA.
This contract can be revoked within 2 days without giving reasons by either side.
A partial or complete change or withdrawal of the contract after confering is possible only up to the time of shipping.
After the time of shipping withdrawal is no longer possible.
A delivery which is not accepted constitutes withdrawal by the Buyer, which leads to reimbursement of the costs thereby incurred.

2. Payment and Prices

The prices are sale prices without shipping and collect-on-delivery fees.
Payment is normally done by collect on delivery.
Customers in Austria and Germany can, after agreement, pay by bank/postal transfer.

3. Delivery

Delivery is done by mail. The postal fees follow the tariffs in effect of the Austrian Post Ltd..
Delivery is done at the Buyer's expense.

4. Right to Return

The return of goods within 14 days after receipt is possible at the Buyer's expense.
An exchange of goods with a specification of the faults is to be done within 14 days from receipt.

5. Retention of Title

The goods remain the property of the EMPA until paid in full.

6. Guarantee

The EMPA guarantees the quality and fitness of the goods. Should there still be reason for complaint, the EMPA will exchange the claimed goods at its own expense.

7. Protection of Privacy

All data are used only for the EMPA. These data are not passed on to third parties.

8. Applicable Law

The contract is governed by Austrian law. Jurisdiction is by court in Saalfelden am Steinernen Meer, Austria.
